Creature Cabinet – Terms of Service

Welcome to Creature Cabinet (“we,” “us,” or “Creature Cabinet”), operating the online store at creaturecabinet.com (the “Site”). These Terms of Service (“Terms”) govern your access to and use of the Site, including browsing, shopping, and purchasing pet supplies. By accessing or using the Site, you (“you” or “User”) agree to be bound by these Terms, our separate Privacy Policy (available at https://creaturecabinet.com/privacy), and all applicable laws, including those of the State of Maryland. If you do not agree, do not use the Site.
1. Acceptance and Modification of Terms
1.1 Acceptance
Your use of the Site constitutes your agreement to these Terms in their entirety.
1.2 Modification
We may update these Terms at any time. Revised Terms will be posted with a new “Last Updated” date. Continued use after changes means you accept the updated Terms. However, material changes to Section 13 (Dispute Resolution) will not apply to any claim or dispute that arose before the revised Terms were posted. We will notify users of such changes via email or prominent banner on the Site.
2. Company Overview and Eligibility
2.1 Business Model
Creature Cabinet operates as a drop-shipping retailer of pet supplies. We facilitate sales; third-party suppliers handle inventory and fulfillment. We do not stock products ourselves.
We sell pet supplies and accessories. We do not sell live animals, pets, or creatures of any kind.
2.2 Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and have legal capacity to contract under Maryland law.
3. Intellectual Property
3.1 Ownership
All Site content (text, logos, images, etc.) is owned by Creature Cabinet operated by BK Ventures, LLC. Copyright © 2025–2026. All rights reserved.
3.2 Permitted Use
You may use Site content solely for shopping, placing orders, or contacting us, and for no other purpose without our prior written permission.
3.3 Restrictions
No content from the Site may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any form or by any means without our express written consent. Unauthorized use may violate copyright, trademark, and other applicable laws, potentially resulting in civil or criminal penalties.
4. Account Management and Site Use
4.1 Registration
You may create an account to enhance your shopping experience (e.g., order tracking). You agree to provide accurate, current, and complete information and to maintain the confidentiality of your account credentials.
4.2 Security
You are responsible for all activities under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
4.3 Prohibited Conduct
You may not:
- Use the Site for unlawful purposes or in violation of Maryland law, including the Maryland Consumer Protection Act (Md. Code Ann., Com. Law § 13-101 et seq.);
- Introduce malicious code (e.g., viruses) or use automated systems (e.g., bots) to disrupt Site functionality;
- Attempt to gain unauthorized access to Site systems.
5. Orders and Payment
5.1 Order Acceptance
- Your receipt of an order confirmation (electronic or otherwise) does not signify our acceptance of your order or confirm our offer to sell. We reserve the right to accept, decline, or adjust the quantity of your order for any reason, including product availability, pricing errors, or suspected fraud, even after confirmation.
- For multiple product orders, we will attempt to ship all items together. If items are unavailable, they will be shipped as they become available unless you instruct otherwise at [email protected].
5.2 Pricing and Taxes
- Prices are in U.S. dollars and exclude shipping fees and applicable taxes (e.g., State sales tax), which will be calculated at checkout.
- In the event of a typographical error or supplier pricing mistake, we may refuse or cancel orders placed at the incorrect price, even if confirmed and charged. If charged, we will refund the incorrect amount to your original payment method.
5.3 Payment
- We accept all major credit cards (e.g., Visa, MasterCard, American Express) with no surcharge. Provide your exact billing address and phone number as registered with your credit card issuer to avoid processing delays.
- Payment is due in full at the time of order placement, and you will be charged upfront for all products and quoted shipping fees.
6. Shipping and Delivery
6.1 Shipping Policy
We ship exclusively to addresses within the United States. We do not ship internationally, to U.S. territories (except where carriers allow), or APO/FPO addresses (unless approved prior to checkout). All shipping options and costs are calculated and displayed at checkout for eligible U.S. addresses only. Orders placed with ineligible shipping addresses will be cancelled and refunded.
Most in-stock orders ship the next business day, excluding weekends and holidays, unless prior arrangements are made. Shipping times are estimates only, and we cannot guarantee delivery dates due to our drop-shipping model and reliance on third-party carriers. 6.2 Risk of Loss
Title and risk of loss transfer to you upon the supplier’s delivery of the product to the shipping carrier, per Maryland’s Uniform Commercial Code (Md. Code Ann., Com. Law § 2-401(2)).
7. Returns and Refunds
7.1 Return Policy
- We accept returns of defective products (due to manufacturing or workmanship issues) or items shipped in error at no cost to you. Products must be unused, in original packaging, and in resaleable condition.
- Non-defective returns (change of mind) are accepted within 30 days subject to the following fees and conditions. Return must be initiated within 30 days of delivery by contacting [email protected] for a Return Merchandise Authorization (RMA). Authorized returns are subject to: (i) a 20% restocking fee based on the product price; (ii) return shipping costs paid by you; and (iii) inspection upon receipt confirming the item is unused and in resaleable condition. We do not accept returns after 30 days or on opened/used items except where required by law.

7.2 Refunds
Refunds for approved returns will be issued to your original payment method within 14 business days of receipt and inspection. Shipping fees are non-refundable unless the return is due to our error or a defect.
Note: This policy is subject to Maryland law and any non-waivable consumer rights under the Maryland Consumer Protection Act.
8. Privacy
8.1 Data Collection
When you purchase from Creature Cabinet, we collect your name, email address, credit card information, shipping address, phone number, and password to process orders, update you on your purchases, and personalize your experience.
8.2 Security
We use advanced encryption and firewall technology to protect your information, in compliance with the Maryland Personal Information Protection Act (Md. Code Ann., Com. Law § 14-3501 et seq.) and the Maryland Online Data Privacy Act (MODPA). MODPA enforcement begins April 1, 2026; our practices will remain fully compliant.
8.3 Communications
We may send you promotional emails about offers, specials, and new products. You may unsubscribe by following the instructions in any email received.

9.1 Disclaimer
The Site may contain links to third-party websites operated by entities unaffiliated with Creature Cabinet. We are not responsible for the operation, content, or privacy practices of these sites. Accessing such links is at your own risk.
10. Product Safety
10.1 Use and Warnings
Our pet supplies (toys, grooming products, nail grinders, deshedding tools, etc.) are intended strictly for use as directed on the product labels or packaging. Pet and Human Safety Warning: Many products can cause injury, illness, allergic reactions, choking, cuts, or death to pets/animals or humans if misused, applied incorrectly, or if the pet has unknown sensitivities/allergies. Examples include:
- Choking hazards from toys
- Chemical irritation or toxicity from shampoos/conditioners
- Cuts or abrasions from grooming tools
Always:
- Read and follow all instructions
- Supervise use at all times
- Test on a small area first for allergies
- Consult a licensed veterinarian for any health concerns
You (the buyer) assume all risks associated with use, misuse, modification, or application of any product to the extent permitted by law. We are not responsible for harm resulting from normal use or improper use except where Maryland law imposes strict product liability or other non-disclaimable obligations. You assume all risks of use as further described in Section 11 (Limitation of Liability).
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW (INCLUDING CURRENT AND FUTURE MARYLAND LAW AND THE UNIFORM COMMERCIAL CODE), THE SITE AND ALL PRODUCTS (INCLUDING THOSE DROP-SHIPPED BY THIRD-PARTY SUPPLIERS) ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES BEYOND THOSE EXPRESSLY REQUIRED BY LAW. We disclaim all implied warranties of merchantability, fitness for a particular purpose, or non-infringement to the maximum extent allowed by Md. Code Ann., Com. Law § 2-316.
USE AT YOUR OWN RISK. By purchasing, receiving, or using any product sold or fulfilled by Creature Cabinet (including drop-shipped items from third-party suppliers), you knowingly and voluntarily assume all risks of injury (including death), property damage, or any other loss or harm arising from the purchase, possession, use, misuse, modification, resale, or disposal of the products. All products must be used strictly in accordance with the manufacturer’s instructions, safety warnings, and all applicable laws. You are solely responsible for proper selection, inspection, installation, use, maintenance, storage, and supervision of the products. (See also Section 10 – Product Safety.) Our total liability for any claim arising from these Terms, the Site, or any product shall not exceed the amount you actually paid for the specific product(s) at issue, except to the extent Maryland or federal law expressly prohibits such limitation. We are not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages (including but not limited to personal injury, death, property damage, loss of use, loss of profits, or emotional distress) except where prohibited by law.
Important Exception: Nothing in these Terms limits or excludes liability for claims arising under strict product liability, personal injury, or wrongful death laws that cannot be disclaimed under Maryland law. Your rights under the Maryland Consumer Protection Act, product liability statutes, and all other non-waivable federal or State rights remain fully intact. This section does not apply to any mandatory consumer protections and shall be interpreted to preserve all non-waivable statutory rights. You agree that the limitations and disclaimers in this Section 11 and in Section 12 (Indemnification) are reasonable and material to our willingness to provide the products at the prices offered. This section survives termination of these Terms or any purchase.
12. Indemnification
You agree to indemnify, defend, and hold harmless Creature Cabinet, its members, officers, employees, and suppliers from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:
- Your breach or violation of these Terms;
- Your willful misconduct or gross negligence in using the products; or
- Any claims resulting from your modification of products or use contrary to provided instructions, but only to the extent such harm is not caused by a product defect for which we are legally responsible.
- Any claims covered by the assumption-of-risk provisions in Section 11.
This obligation survives termination of these Terms.
13. Dispute Resolution
13.1 Governing Law
Maryland law (without conflict-of-laws rules).
13.2 Arbitration
Binding arbitration in Baltimore, Maryland, under AAA Consumer Arbitration Rules. No class actions.
13.3 Jurisdiction
If arbitration is unenforceable, exclusive venue in state or federal courts of Baltimore County, Maryland.
14. General Provisions
14.1 Supersession
These Terms supersede any conflicting terms in your purchase orders, whether signed by us or not.
14.2 Severability
If any provision is deemed invalid, the remaining provisions remain enforceable.
14.3 Entire Agreement
These Terms, our Privacy Policy, and order-specific terms at checkout form the complete agreement between you and Creature Cabinet.
